We provide legal representation for businesses, individuals and non-profits that are being sued, need to sue, or are otherwise involved in civil litigation or pre-litigation situations. Below you will find detailed information about some of my more common practice areas, but we have a breadth of experience in many other legal matters as well. Please reach out to us and schedule a free consultation to see how we can help.
Contract Litigation and Drafting
Contracts form the basis of every transaction. Whether business-to-consumer, business-to-business, individual-to-individual, written, oral, scribbled on a napkin, agreed to via e-mail, accepted by clicking a webpage box, or otherwise, each of us enters into multiple contracts every day.
Each of those contracts, however, is susceptible to hundreds of issues:
Each of those contracts, however, is susceptible to hundreds of issues:
- There can be disagreement as to what a particular term means.
- Circumstances can arise that no one was thinking about when the contract was written that the parties cannot agree on how to handle.
- Sometimes persons or entities that you contract with either cannot or will not do what they said they would do.
Electronic Discovery
The importance of electronically stored information, or "ESI", on litigation cannot be overstated, and it's impact is growing exponentially every year. As more and more data, emails and documents are stored in digital format only, traditional methods of document review and fact-gathering are becoming obsolete. Our ability to effectively and efficiently manage ESI, including its collection, document requests, litigation support vendors/review platforms (such as Relativity and Recommind), and disputes relating thereto (including motions to compel, motions to quash subpoenas, motions for protective orders, etc.) arises from our experience being solely responsible for managing electronic discovery efforts in several multi-million dollar litigation matters. If you know or believe that ESI will be at issue in your litigation, consider reaching out to us to see if I can help you navigate this increasingly complex set of terminology, practices and procedures.
Plaintiff's Representation
I also represent individuals who have been wronged by corporate, government, or individual actors. I have successfully challenged health insurance companies, government agencies, property and casualty insurance companies, financial institutions, retailers, individuals and employers.
Simply because a government agency, person or company sends you a letter or tells you over the phone that something “is” or that there is “nothing they can do”, this does not make it "so" in the eyes of the law. I firmly believe that all companies, agencies, and people are required to conduct themselves within the confines of the law and the contracts they sign with their customers and the public. I can help you keep others to their word and to their legal obligations.

Judgment Enforcement
I have handled the enforcement of hundreds of commercial judgments in dozens of different courts on behalf of law firms, commercial entities, and individuals. I am well-versed with proceedings supplemental hearings, bank, wage and asset garnishment procedures, and all manner of post-judgment discovery.
I have also pursued commercial judgment defendants in bankruptcy court, both through the filing of proofs of claim, and, where appropriate, successful filing of adversary claims to have certain debts declared non-dischargeable in bankruptcy. I have also filed fraudulent transfer, corporate veil-piercing, and alter-ego claims to collect judgments from subsequent entities in both Federal and State courts in Indiana.
If you have a commercial claim (i.e., non-consumer debts/debts that aren't related to purchases for personal, family or household use) against someone pre-litigation, I can help turn your claim into a judgment. If you have already been through litigation and have a commercial judgment, but want to turn that judgment into actual dollars, I have broad, deep experience in utilizing all available procedural mechanisms to satisfy your commercial judgment.

Bankruptcy Litigation
There are many law firms that you can turn to in order to file your Chapter 7 or Chapter 13 bankruptcy, which is a service that I generally do not provide. However, there are far fewer firms that have significant experience with contested bankruptcy adversary matters (lawsuits filed within a bankruptcy by the bankruptcy trustee, creditors, and other interested parties). If you have filed bankruptcy or are otherwise being sued for non-dischargeability, avoidance of fraudulent transfers, preferences, or have otherwise been named as a defendant in a bankruptcy adversary proceeding—you should consider engaging a tested fighter to specifically handle these disputes.
I also represent non-debtor defendants in cases filed by bankruptcy trustees and creditors, with a particular emphasis on defending preferential transferee defendants (typically family members) through the ordinary course of business, reasonably equivalent value, and other defenses. Preference and fraudulent transfer claims are fact-specific cases that require a nuanced understanding of the various defenses available, what evidence is required to prove both the claims and the defenses, and how to use the law and evidence to effectively negotiate with bankruptcy trustees to resolve these disputes early and without protracted litigation. If you have been named in a bankruptcy adversary case or are involved with a dispute with a bankruptcy trustee, I would be happy to talk with you to determine if our services fit your needs.
